Can the executor sell the house before probate is finished?
Often yes, but only after the court has appointed the executor or administrator and the sale is allowed under the will or court rules. Ask your probate attorney what authority you have before you sign a contract. I won't ask you to sign anything until your attorney says you're clear to sell.
Does Kentucky have an inheritance tax?
Yes. Kentucky has an inheritance tax paid by the person who inherits, and no estate tax. Spouses, parents, children, grandchildren, siblings, and half-siblings are exempt. Nieces, nephews, and some other relatives get a $1,000 exemption and pay 4% to 16% above it. Everyone else gets a $500 exemption and pays 6% to 16% above it.
When is the Kentucky inheritance tax due?
The return is generally due within 18 months of the date of death, and a 5% discount applies if the tax is paid within nine months. The tax falls on each beneficiary, and selling the house doesn't remove the filing requirement. Ask your attorney or the Kentucky Department of Revenue about your return.
Will I owe tax when I sell an inherited house?
It depends. Inherited property is generally valued for tax purposes as of the date of death, which often means little or no taxable gain if you sell soon after. Every situation is different, so ask a tax professional before you sell.
